
Lesson 22 – Carrying While Consuming Alcohol – Legal but Risky
Minnesota law does not prohibit permit holders from carrying a firearm into establishments that serve alcohol. However, carrying while under the influence is a criminal offense.
🍺 Legal Threshold (MN Statute 624.7142):
- It is illegal to carry a pistol when under the influence of alcohol or controlled substances
- A blood alcohol concentration (BAC) of 0.04 or higher is considered under the influence
- This applies anywhere, not just in bars or restaurants
⚠️ Risk Factors:
- Even one drink can impair judgment — avoid carrying if you plan to consume alcohol
- Alcohol use complicates any self-defense claim and may result in immediate permit suspension
- Law enforcement and prosecutors may treat armed individuals under the influence very seriously
