Lesson 5.3: Carrying a Firearm in Public

Purpose of This Lesson

Public carry requires control, judgment, and awareness of the law.

A permit allows lawful carry where allowed. It does not remove responsibility.

Public Carry Under Minnesota Law

Minnesota Statute 624.714 addresses carrying, holding, possessing, or otherwise controlling a pistol in public places and vehicles, unless an exception applies.

A permit holder must still follow state law, federal law, private property rules, restricted location rules, and lawful commands from law enforcement.

What Public Place Means

Minnesota Statute 624.714 uses the public place definition found in Minnesota Statute 624.7181.

In plain language, public carry means carrying around other people, on property you may not control, and in places where careless conduct can quickly become a legal problem.

Carrying Means Control

If you carry a pistol, you are responsible for controlling it.

The pistol should remain secured in a proper holster or otherwise controlled in a safe and lawful manner.

Do not handle it casually, adjust it unnecessarily, display it for attention, or touch it to make a point.

Handling or Displaying a Firearm in Public

Minnesota does not rely on the word “brandishing” the same way some other states do, but careless or threatening firearm handling can still create serious legal problems.

Minnesota Statute 609.66 addresses reckless handling or use of a gun or dangerous weapon, and intentionally pointing a gun at or toward another person.

Do not touch, adjust, display, point, or handle your firearm in public unless there is a lawful and necessary reason.

Carrying in a Vehicle

A permit holder should know whether the firearm is being carried, transported, stored, or left behind because the destination is restricted.

Plan before you leave home.

Keep the firearm secured. Keep your hands off it unless there is a lawful reason to handle it. Avoid unnecessary attention. Follow the law.
