Lesson 7.4: Private Property, Signs, and Requests to Leave

Purpose of This Lesson

Private property rules matter.

This lesson explains private establishment signs, personal notice, requests to leave, parking areas, private residences, and landlords.

Private Establishments

Under Minnesota Statute 624.714, subdivision 17, a private establishment may make a reasonable request that firearms not be brought into the establishment.

A reasonable request can be made by proper posting at the entrances or by personal notice from the operator or the operator’s agent.

Minnesota law is specific about what proper posting requires. A small sticker, vague symbol, or poorly placed sign may not meet the statutory standard.

That does not mean arguing at the door is smart.

Requests to Leave

A person who remains after knowing the operator or agent made a reasonable request may be ordered to leave.

A person who fails to leave when requested is guilty of a petty misdemeanor.

The practical rule is simple: if you are asked to leave, leave.

Parking Areas, Residences, and Landlords

The owner or operator of a private establishment may not prohibit lawful carry or possession of firearms in a parking facility or parking area.

This subdivision does not apply to private residences. The lawful possessor of a private residence may prohibit firearms and give notice in any lawful manner.

A landlord may not restrict lawful carry or possession of firearms by tenants or their guests.
