Lesson 9.4: Drawing or Displaying a Firearm Is a Serious Legal Act
A firearm is not a warning tool for ordinary conflict.
Drawing or displaying a firearm changes the situation immediately. It is not used to scare someone, prove a point, protect pride, or force compliance.
Dangerous Weapon Conduct
Under Minnesota law, a firearm is a dangerous weapon whether loaded or unloaded.
Minnesota law also addresses reckless handling or use of a gun, and intentionally pointing a gun at or toward another person.
A permit does not make reckless, angry, careless, or unnecessary firearm handling lawful.
Display Is Not De-escalation
A pistol may become visible during lawful carry or proper administrative handling.
That is different from intentionally displaying a firearm during conflict to scare, threaten, intimidate, or control another person.
If the facts do not support lawful defensive force, drawing or displaying the firearm may create the legal problem instead of solving it.
Davey Defense Standard
A firearm is not a negotiation tool, threat tool, or anger management tool.
If the facts do not support that level of response, the firearm stays holstered.
