
Lesson 7.2: Schools, School Property, and Colleges
Purpose of This Lesson
Schools and school property have special firearm restrictions.
The practical rule is simple: do not guess around schools.
K-12 Schools, Child Care, and School Buses
Under Minnesota Statute 609.66, subdivision 1d, a person generally may not possess, store, or keep a dangerous weapon while knowingly on school property unless an exception applies.
School property includes K-12 school buildings and improved grounds, licensed child care centers while children are present, school buses used for school-related transportation, and properly posted areas under temporary exclusive school control.
Permit Holders and Vehicles
A Minnesota Permit to Carry does not make school property open carry territory.
Do not carry on your body on K-12 school property unless a clear statutory exception applies.
Minnesota law includes specific vehicle exceptions for permit holders, including being in a motor vehicle or directly placing a firearm into, or retrieving it from, the trunk or rear area of the vehicle.
The vehicle language is specific. Do not stretch it beyond what the statute says.
Written Permission and School Activities
Minnesota law includes exceptions for certain firearm safety or marksmanship activities, gun or knife shows, ceremonial color guard possession, and possession with written permission from the proper school or child care authority.
Do not assume permission. Get it clearly and in writing when written permission is required.
Colleges and Universities
Postsecondary schools are handled differently from K-12 school property.
Certain public postsecondary institutions may establish firearm policies for students while on institution property. Employers may also establish firearm policies for employees while acting in the course and scope of employment.
An employer or postsecondary institution may not prohibit lawful carry or possession of firearms in a parking facility or parking area.
Know the policy. Do not assume college rules work the same as K-12 school property law.
